Houston law firm says lawsuit sends strong message that health and safety of offshore workers must be safeguarded by employers.

Arnold & Itkin LLP has filed a lawsuit against Transocean Deepwater Drilling, Inc. and BP on behalf of an offshore worker injured in the explosion of the Deepwater Horizon drilling rig.



The lawsuit filed in Galveston County Court in Texas on April 29 (Case # 62,738, Joshua Kritzer v. Transocean et al) alleges that seaman Joshua Kritzer suffered serious injuries when he was thrown 25 to 30 feet down a hall and knocked unconscious during the April 20 explosion of the Deepwater Horizon.



After regaining consciousness and frantically removing debris that had fallen on him, Kritzer escaped the burning rig by climbing over a collapsed wall to a life raft, the lawsuit alleges.



The lawsuit asserts a Jones Act claim alleging the Deepwater Horizon was unseaworthy and the defendants were grossly negligent in operating the vessel with inadequate crew, failing to maintain it and failing to properly supervise the crew.



The Jones Act is a federal law that gives injured seamen the legal right to sue maritime employers in cases of negligence and unseaworthiness.



“This lawsuit sends a strong message that the health and safety of offshore workers must be safeguarded by employers,” said Kurt Arnold (http://www. arnolditkin. com/attorney-profiles/kurt-arnold-lawyer. php), a partner in Arnold & Itkin LLP (http://www. jones-act-maritime-lawyer. com/index. php), who filed the lawsuit.



Kritzer was among more than a dozen crew members injured in the explosion. Eleven crew died in the blast before the massive oil rig eventually sank into the Gulf of Mexico. The Deepwater Horizon was owned by Transocean, a Swiss company, and leased to BP, which was drilling about 50 miles off the coast of Louisiana.



As a result of the explosion, Kritzer, a resident of Louisiana, sustained a closed head injury along with injuries to his ankle and hip, resulting in physical pain and mental anguish, the lawsuit alleges. The lawsuit demands the defendants pay Kritzer’s past and future medical expenses and support under the general maritime law benefits of maintenance and cure. It also alleges he has sustained a loss of future earning capacity.

"Since 9-11, airline workers have sacrificed their wages, pensions, work rules and thousands of jobs in order to rescue the airline industry," said Roach. "Industry conditions have imposed great burdens on workers as carriers compete to reduce costs. Such an extraordinary focus on the bottom line demands more, not less, government oversight."



Roach urged the Committee to resolve jurisdictional conflicts between the National Mediation Board and the National Labor Relations Board; address Flight Attendant fatigue and self-defense training issues and correct lax enforcement of workplace health and safety regulations. Roach also called for improved oversight of overseas aircraft repair stations and urged lawmakers to reject proposals to allow increased foreign ownership and control of U. S. airlines.

Northampton Citizens Appeal Adult Store Approval in Land Court



Michael A. Kirby and Lucille J. Stone, long-time residents of Northampton, have appealed the approval of plans to build a Capital Video store just steps from their home. Capital Video, which operates a large national chain of adult stores, plans to sell hard-core pornographic magazines and videos. The appeal, filed on January 8 with the Massachusetts Land Court, asks the court to require Capital Video to prepare plans that conform to Northampton's Zoning Ordinance and address the concerns of the community.

Michael A. Kirby and Lucille J. Stone, long-time residents of Northampton, have appealed the Northampton Planning Board's approval of Capital Video's plans to build an adult retail store at 135 King Street in Northampton. Capital Video, based in Cranston, RI, is a large national chain of adult stores owned by Kenneth Guarino. The appeal was filed with the Massachusetts Land Court on January 8, 2007. The case number is 07MISC336907. The named defendants are the members of the Planning Board and Capital Video.



Northampton (population 29,000) is the home of Smith College, the nation's largest liberal arts college for women. The city is famous for its pedestrian-friendly historic downtown, which is located less than half a mile from the proposed adult store.



Kirby and Stone live within 300 feet of 135 King Street. The front of the adult store will be plainly visible from the front porch of their home, which they have lived in for 25 years.



The goal of the couple's appeal is not to prevent any kind of adult store from opening at 135 King, but for Capital Video to prepare a site plan that conforms to Northampton's Zoning Ordinance and addresses the concerns of the community. Among other things, Northampton's Zoning Ordinance forbids signs that depict sexual conduct or sexual excitement.



Immediately after the Planning Board rendered its 4-3 approval of Capital Video's plans on December 14, dissenting board member Kenneth Jodrie called Capital Video's submission "one of the poorest I've seen in a long time, both in terms of the quality of the drawings and making no effort to meet the requirements of what the town has been talking about for the last three months."



To keep costs reasonable, Kirby and Stone have filed their appeal pro se. They have not engaged a lawyer to represent them at this time, nor is NoPornNorthampton formally involved with their appeal. NoPornNorthampton is a group of Northampton citizens who organized in mid-2006 to raise awareness about porn and who have been critical of Capital Video's efforts to locate a hard-core pornography shop in the midst of homes, churches, counseling centers and a school of dance.



On December 20, NoPornNorthampton issued an open letter to Capital Video attorney Michael Pill, inviting him to dialogue with the community about the deficiencies in Capital Video's plans. These deficiencies include adherence to a non-qualifying "Victoria's Secret standard" for signage, failure to demonstrate safe pedestrian and vehicular flows in and around the site, and failure to address public health and safety issues around the site. Other Capital Video stores, for example, have experienced problems with hazardous trash, such as that seen in Kittery, ME (http://nopornnorthampton. org/2006/07/02/what-kittery-found-at-the-porn-shop. aspx) and Meriden, CT (http://nopornnorthampton. org/2006/07/17/what-lies-behind-capital-videos-meriden-porn-shop. aspx).



Issues with Capital Video's plans that are debatable, such as whether to fence off their parking lot from a bike trail that will run behind it, should receive input from professionals such as the Northampton police.



Despite Capital Video's posture of openness at their December 14 Planning Board hearing and in an earlier letter to city officials, no response has been received to date to NoPornNorthampton's letter. Kirby and Stone acted to stand up for the quality of their neighborhood and filed their appeal before the close of the 20-day appeal period.



It is hoped that Capital Video will now devote their energies to improve their site plan and "provide a comfortable environment to all" (their stated goal) rather than attempt to exhaust and outspend the community with legal machinations.

It is every woman's responsibility to know the causes and symptoms of breast cancer and sexual transmitted disease.

If a woman ever experienced unusually painful menstruation or noticed lumps in their breasts and vaginal discharge similar to cottage cheese, there is a great possibility she's in trouble. Any sensible woman should immediately set an appointment and see her trusted gynecologist. Women's health is often a subject taken for granted. Most women wait until they are rushed to the hospital before they do something about their condition. Experts in women's health advise ladies to be 'listen' and 'understand' their bodies. Even a seemingly trivial symptom should not be ignored as it may be a telltale sign of deadly breast cancer or a form of sexually transmitted disease.



Women can actually detect early stages of cancer through simple do-it-yourself breast assessment. Two or three days after every menstruation period, a woman should gently check her breasts for possible lumps or change in color and texture. Gynecologists say cancerous lump is usually a firm and solitary mass that just stays in a particular spot. If a lump changes position, there's a big possibility that it is non-malignant. Aside from lumps, a woman should also watch out for the disturbing presence of veins, breast discharges which are watery or mucus-like, and nipples that are inverted. According to women's health advocates, those who have a breast cancer history in their families are more prone to acquire the illness. But even if a woman doesn't have breast cancer history, it wouldn't hurt if she regularly examine her breasts for safety measure.



Apart from breast cancer, another illness concerning women's health is sexually transmitted disease. STD can manifest in the form of chlamydia, syphilis, genital herpes, and gonorrhea. Even if a lady is not sexually active and doesn't engage in extra-marital sexual affairs, she can still obtain STD from her philandering husband or boyfriend. General symptoms of STD include thick and smelly vaginal discharge, bumps or rashes, and burning sensation in the feminine area. A woman infected with STD can also experience pain when having sexual intercourse and irregular bleeding in between menstrual cycles. Medication varies from one STD kind to another (and also depending on the severity of the case). For prevention, experts advise women to use condom which is not only a form of contraceptive but also serve as protection against STD. Husbands, on the other hand, should avoid womanizing and extra-marital sexual intercourses as much as possible. The fight against STD should be a concerted effort between husband and wife. In the case of STD, husbands are also involved in the issue of women's health.

Walden University Public Health Alumna Awarded Commander's Coin



Air Force veteran Tanisha Harding was recognized for work completed during her field practicum at the Columbus (MS) Air Force Base.

Walden University Master of Public Health graduate Tanisha Harding was recently awarded a Commander's Coin by Col. Susan R. Hall in recognition of Harding's service to Columbus Air Force Base in Mississippi. The Commander's Coin is a highly prized symbol of recognition that military commanders award to individuals who demonstrate exceptional service. Harding, a former Air Force captain, completed the field practicum for her degree by working at the base's public health office.



"It is the exception, not the rule, that graduate students seek to complete their practicum in the military setting," says Hall, commander of the 14th Medical Group. "So when Ms. Tanisha Harding sought out the medical clinic which I command, I jumped at the opportunity."



During her time on the base, Harding observed and participated in a variety of tasks that fall under Air Force Public Health responsibility, including patient education, food facility sanitation, disease surveillance, occupational injury and illness prevention, and immunization tracking. Specifically, Harding assisted with projects such as the base's "Biggest Loser Contest" finale, updating the food storage training booklet, and investigating complaints of a "sick" house.



It was during her third year in the Air Force that Harding decided to use her bachelor's in biology to pursue an advanced degree in public health. "I heard about Walden from the base education office and other avenues and decided to give it a try," Harding says.



The flexibility of the online program allowed her to relocate with her husband who is still active duty Air Force. With her master's degree in hand, she now is off to Ramstein Air Base in Germany, where her husband is currently stationed.
